1. Acceptance of Terms

By creating an account or using FreshReturn, a service operated by 16717870 Canada Inc., you agree to be bound by these Terms of Service. If you do not agree, please do not use our service.

2. Description of Service

FreshReturn provides an automated SMS reminder platform for barbershops and salons. The service sends SMS messages on behalf of participating businesses to their clients based on visit history, helping increase rebookings. The service includes appointment data import, smart timing algorithms, and automated message delivery. Businesses are solely responsible for obtaining and maintaining valid customer consent for SMS communications in compliance with all applicable laws, including Canada's Anti-Spam Legislation (CASL). FreshReturn acts as a technology provider and is not responsible for the consent practices of businesses using the platform.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. You must provide accurate and complete information when creating your account.

4. Acceptable Use & SMS Consent

You agree to use FreshReturn only for its intended purpose of sending appointment reminders to your clients. You must obtain valid consent from your customers before uploading their data to the platform, in compliance with Canada's Anti-Spam Legislation (CASL) and any other applicable regulations. You agree not to use the service to send spam, promotional messages unrelated to appointments, or any content that violates applicable laws. 5. Billing & Subscriptions

FreshReturn offers paid subscription plans billed monthly. All plans include a 30-day free trial. You will not be charged during the trial period. After the trial ends, your selected plan will be charged automatically. You can cancel your subscription at any time from your dashboard.

6. SMS Limits & Fair Use

Each plan includes a set number of SMS reminders per month. These limits are designed to ensure respectful communication and prevent spam. Exceeding your plan's limits may result in paused reminders until the next billing cycle.

7. Termination

You may cancel your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior. Upon termination, your data will be deleted within 30 days.

8. Limitation of Liability

FreshReturn is provided "as is" without warranties of any kind. We are not responsible for any lost revenue, missed appointments, or other damages arising from the use of our service. Our total liability shall not exceed the amount you paid for the service in the preceding 12 months.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the dashboard. Continued use of the service after changes constitutes acceptance of the updated Terms.
